MEXICAN OFFICIAL NORM NOM-051-SCFI-1994, GENERAL SPECIFICATIONS IN LABELING FOR PRE-PACKED FOODS AND NON-ALCOHOLIC BEVERAGES
SCFI, through DGN, and based on article 34 of the Federal Public Administration Organic Law (Ley Orgánica de la Administración Pública Federal); articles 1, 39 (V), 40 (XII), 47 (IV) of the Federal Law on Metrology and Normalization (Ley Federal sobre Metrología y Normalización); articles 9 and 24 (I), (XV) of the SCFI Internal Rules (Reglamento Interior de la Secretaría de Comercio y Fomento Industrial); article 5 (XIII)(a) of the Act that Organically appoints Administrative Units and delegates Powers to Vice-Secretaries, the Chief Clerk, Unit Managers, General Managers, the General Coordinator and other subalterns of the Commerce and Industrial Development Department (Acuerdo que adscribe Orgánicamente Unidades Administrativas y delega facultades en los Sub-secretarios, Oficial Mayor, Jefes de Unidad, Directores Generales, Coordinador General y otros Subalternos de la Secretaría de Comercio y Fomento Industrial); published in the Diario Oficial de la Federación (DOF by its acronym in Spanish) on March 29, 1994 and reformed by the Decree published in the DOF on September 14, 1994, and
WHEREAS
It is necessary to improve the regulatory framework for the national economic activity;
It is the responsibility of the Federal Government to take the necessary steps to warrant that products and services marketed in the National Territory exhibit the necessary information so that consumers and users may adequately make buying decisions, and use and fully enjoy the products and services they acquire;
The Federal Law on Metrology and Normalization establishes that Mexican Official Norms are created as the ideal instrument to pursue these objectives, the following Mexican Official Norm NOM-058-SCFI-1994 GENERAL SPECIFICATIONS IN LABELING FOR PRE-PACKED FOODS AND NON-ALCOHOLIC BEVERAGES is issued .
To this effect, this Mexican Official Norm shall enter into force on November 1, 1996, except for the provisions related to nutritional information, which shall enter into force on January 1, 1998.

PRE-PACKED FOODS AND NON-ALCOHOLIC BEVERAGES
1. Purpose
The purpose of this Mexican Official Norm is to stipulate the commercial information to be specified on the labels of pre-packed foods and non-alcoholic beverages of domestic or foreign manufacture, as well as to establish the characteristics of such information.
1.1 Application
This Norm is applicable to all pre-packed foods and non-alcoholic beverages of domestic and foreign manufacture offered for sale to consumers in National Territory.
This Norm does not apply to:
a) Pre-packed foods and non-alcoholic beverages subject to commercial information rules contained in specific Mexican Official Norms or any other valid norm;
b) Products in heaps, bulks, lot;
c) All other products as determined by the competent authority, in accordance to its powers.

3. Definitions
For the purposes of this Norm, the following definitions are stipulated:
3.1 Additive
Those allowed substances, that are added directly to the foods and non-alcoholic beverages during their manufacture, and whose usage allows some technological function to be achieved.
3.2 Food
Any substance or product, solid, semi-solid or liquid, natural or processed, destined for human consumption, providing an organism with elements for its nourishment consumed orally.
3.3 Sugars
All monosaccharides and disaccharides present in a food or non-alcoholic beverage.
3.4 Non-alcoholic beverage
Any natural or processed liquid, destined for human consumption, that provides an organism with elements for its nourishment consumed orally, and that does not contain more than 0.5 percent in volume of ethyl alcohol.
3.5 Manufacturing Coadyuvants
Nourishment or matter, excluding devices, utensils and additives, not consumed as a food by itself, and used intentionally in the manufacturing of primary materials, foods or their ingredients, in order to achieve a technological function during treatment or manufacture, which may result in the non-intentional, but inevitable, presence of residues or by-products in the final product.
3.6 Consumer
Person or entity who acquires or enjoys, as a final recipient, pre-packed food products and non-alcoholic beverages. One who acquires, stores or uses pre-packed foods and non-alcoholic beverages with the intention of integrating them in processes of production, transformation, marketing or providing services to a third party is not a consumer.
3.7 Contents
Quantity of pre-packed product that because of its nature may be measured for its marketing, by numeric product units.
3.8 Net Contents
Quantity of pre-packed product that remains after all tare deductions have been made, if applicable.
3.9 Characteristics Declaration
Any text or representation that assures, suggests or implies that a pre-packed food or non-alcoholic beverage has special properties because of its origin, nutritional properties, nature, manufacture, composition or any other property, except for the brand of the product and the name of the ingredients.
3.10 Nutritional Properties
Any declaration or representation that assures, suggests or implies that the pre-packed product has particular nutritional properties, both in relation to its energetic and protein, fat (lipid) and carbohydrates content, and its vitamin and mineral contents.
The following do not constitute nutritional properties declarations:
a) The specification of substances in the ingredients list, or the name or brand of the pre-packed product;
b) The specification of any nutrient or component, when its addition is mandatory;
c) The quantity or quality declaration of nutritional properties of some nutrients or ingredients on the label, when it is required, in accordance with applicable legal norms.
3.11 Nutritional Declaration
List or enumeration of nutritional contents of a pre-packed food or non-alcoholic beverage.
3.12 Packing
Material that wraps, contains and protects pre-packed products, for their storage and shipment.
3.13 Package
Any container or wrap in which the pre-packed product is presented for sale to the consumer.
3.14 Multiple Package
Any container or wrap which contains two or more equal varieties of pre-packed products, destined to be sold to the consumer in such presentation.
3.15 Joint Package
Any container or wrap which contains two or more different varieties of pre-packed products, destined to be sold to the consumer as presented.
3.16 Label
Any sign, mark, lettering, inscription, image or any other descriptive matter either graphic, written, printed, marked, stenciled, high or low embossed, adhered or superposed on the pre-packaged product, or, when such is not possible because of the characteristics of the product, to its packing.
3.17 Expiration Date
Limit date by which the sanitary and quality characteristics of a pre-packed product, stored under the manufacturer’s suggested conditions, are considered to be reduced or eliminated in such a way that, after this date, it must not be marketed or consumed.
3.18 "Best Before" Date
Date on which, under determined storage conditions, the period during which the pre-packed product is marketable and meets all its specific qualities, tacit or implied, expires; but after which, the pre-packed product can be consumed, as long as it does not exceed the expiration date.
3.19 Dietary Fiber
Vegetal matter component that is not digested by digestive enzymes. It includes, fundamentally, structural and non-structural polysaccharides that are not starch nor lignin.
3.20 Technological Function
The effect produced by the use of additives in pre-packed foods and non-alcoholic beverages, that give or intensify their scent, color or flavor; and improves their stability and conservation, among others. See additive.
3.21 Nutritional Information
All description destined to inform the consumer about nutritive properties of a pre-packed food or non-alcoholic beverage. It covers two aspects:
a) Mandatory nutritional information.
b) Supplemental nutritional information.
3.22 Ingredient
Any substance or product, additives included, used in the manufacture or preparation of a food or non-alcoholic beverage, and found in the final product, transformed or not.
3.23 Compound Ingredient
Mixture that is previously made of substances or products which constitutes a finished product and which is used in the manufacture of a different product.
3.24 Warning Inscriptions
Any text or representation warning the consumer about the presence of a specific ingredient or about damage to one’s health that may originate from the abusive consumption of such ingredient.
3.25 Lot
Food produced by a manufacturer during a certain period of time, identified by a specific code.
3.26 Magnitude - Size
Quality of a property or physical attribute of the product, when it can be quantified and expressed in accordance with the General System of Measuring Units. See References.
3.27 Drained Mass
Quantity of solid or semi-solid product that represents the contents of a package, after the liquid has been removed by a previously stipulated method.
3.28 Nutrient
Any substance, including protein (amino acids), fat (lipids), carbohydrates, water, vitamins and minerals, usually consumed as a component of a food or non-alcoholic beverage, and that:
a) provides energy;
b) is necessary for growth, development and maintenance of life; or
c) a lack or shortage thereof will produce characteristic physiologic or chemical changes.
3.29 Serving
Quantity of a product consumed by ingestion, expressed in units of the General System of Measuring Units.
3.30 Product in Heaps, Bulks, Lots
Product that must be weighed, measured or counted in front of the consumer, because it is not pre-packaged at the time of sale.
3.31 Pre-packaged Product
Foods and non-alcoholic beverages that are placed in a package of any kind when the consumer is not present, and the quantity of product in such a package cannot be altered, unless the package is open or modified in a perceivable way.
3.32 Measurement Unit Symbol
Conventional sign by which the measurement unit is represented, in accordance with the General System of Measuring Units. See References.
3.33 Measurement Unit Submultiple
Fraction of a measurement unit formed according to the scale accepted by the General System of Measuring Units. See References.
3.34 Information Surface
Any area on the package or packing other than the main exhibit surface.
3.35 Main Exhibit Surface
That part of the package or the packing given the most importance, because it shows the description and brand of the product. The bottom of such packages may be used as main exhibit surface only when there is no other area with commercial information.
3.36 Measurement Unit
Value of a magnitude (size) whose convention numerical value is equal to one. See References.
4. Specifications
4.1 General Requirements for the Label
4.1.1 Information in pre-packed food and non-alcoholic beverages labels must be truthful and described and presented in such a way as not to mislead the consumer regarding the nature and characteristics of the product.
4.1.2 Pre-packed products subject to this Norm, must be presented with a label which includes a description or written words, illustrations or other graphic representations referring to the product. Labels for pre-packed products may incorporate graphic or descriptive suggestions for use or preparation, provided that there is a corresponding legend.
4.2 Mandatory Information Requirements
4.2.1 Name or denomination of the pre-packed food or non-alcoholic beverage.
4.2.1.1 The name or denomination of the pre-packed product must correspond to the one established in the specific legal norms; in the absence of these, the common use name may be used, or, a description according to the basic characteristics of the composition and nature of the pre-packed food or non-alcoholic beverage, which names or descriptions shall not mislead or defraud the consumer. If it has been treated in any way, the name of such treatment may be indicated, except for those that, according to corresponding ordinances, are mandatory.
4.2.2 Ingredients list
4.2.2.1 The label of pre-packed products which are marketed individually must include an ingredient list. This ingredients list may be omitted when dealing with one-ingredient products.
4.2.2.1.1 Ingredient lists must be headed or preceded by the term "ingredients" ("ingredients").
4.2.2.1.2 Pre-packed food and non-alcoholic beverage ingredients must be listed in a quantitative decreasing order (m/m).
4.2.2.1.3 A compound ingredient must be declared when it constitutes more than 25 per cent of the food or non-alcoholic beverage, and must be accompanied by a list in parenthesis of its own ingredients in a quantitative decreasing order (m/m). When it constitutes less than 25 per cent, the additives that perform a technological function in the manufacturing of a product must be declared, as should those ingredients or additives associated to allergic reactions, in accordance with corresponding legal ordinances.
4.2.2.1.4 Added water must be declared in the ingredients list in its respective order of predominance, except when it is part of a compound ingredient and is thus declared on the list, or when used in cooking and reconstitution processes. It is not necessary to declare water or other volatile ingredients evaporated during manufacture.
4.2.2.1.5 When dealing with condensed or dehydrated foods destined to be reconstituted, ingredients of the reconstituted product may be listed in a quantitative decreasing order (m/m), provided the following specification is included: "product ingredients when prepared according to instructions on label" ("ingredientes del producto cuando se prepara según las instructiones de la etiqueta").
4.2.2.1.6 On the ingredients list, a specific denomination must be used, according to point 4.2.1, with the exception of the ingredients listed in Chart 1, in which a generic description may be used. See Chart 1.
4.2.2.1.7 Notwithstanding the provisions of sub-section 4.2.2.1.6, pork lard and sebum must be declared by their specific denominations.
4.2.2.1.8 When specifying the use of allowed additives in the manufacture of food and non-alcoholic beverages, the specific name or generic denomination of the additive may be used.
4.2.2.2 Manufacturing coadyuvants and transfer of additives.
4.2.2.2.1 All additives used in the ingredients of a pre-packaged food or non-alcoholic beverage must be included in the ingredients list, when such additives are transferred to another pre-packed product in a noticeable quantity or a quantity sufficient to perform a technological function in such other product.
4.2.2.2.2 Additives transferred to pre-packaged food and non-alcoholic beverages that do not perform a technological function in such product are not required to be declared on the ingredients list; the same provision applies for manufacturing coadyuvants, except for those that may cause allergic and intolerance reactions.
4.2.3 Net contents and drained mass.
4.2.3.1 Net contents and drained mass must be declared in units from the General System of Measurement Units, in accordance with NOM-030-SCFI, regardless of whether they can also be expressed in other units. See References.
4.2.4 Name and official address.
4.2.4.1 For domestic pre-packaged foods and non-alcoholic beverages, the name and official address of the manufacturer or company responsible for the manufacture must be indicated on the label. When dealing with imported pre-packaged products, this information must be submitted to the SCFI at its request. The SCFI must provide this information to consumers at their request when there is a complaint by consumers.
4.2.4.2 For pre-packaged imported products, the label must indicate the name and official address of the importer. This information may be attached to the product in National Territory, after customs and before the product is marketed.
4.2.5 Country of origin.
4.2.5.1 Domestic or foreign pre-packaged foods and non-alcoholic beverages must include a statement identifying the country of origin of the products: "Made in ..." ("Hecho en ..."), "Product from ..." ("Produto de ..."), "Manufactured in ..." ("Fabricado en ..."), or other, followed by the country of origin of the product, subject to the stipulations of international treaties Mexico has ratified.

4.2.6 Lot identification.
4.2.6.1 Each package must be engraved or in any way marked, with the identification of the lot it belongs to, with a coded indication, according to applicable legal ordinances.
4.2.6.2 Lot identifications attached by the manufacturer to pre-packaged products cannot be modified or hidden in any way.
4.2.7 Expiration date.
4.2.7.1 Foods and non-alcoholic beverages that must incorporate an expiration date are subject to the established corresponding legal ordinances.
4.2.7.2 When an expiration date is declared, any special conditions required for the conservation of the pre-packaged food or non-alcoholic beverage must be indicated on the label, if the expiration date depends on such special conditions. Statements like:"keep refrigerated" ("manténgase en refrigeración"); "keep frozen" ("manténgase en congelación"); "once thawed do not freeze again" ("una vez descongelado no deberá volverse a congelar"); "once open, keep refrigerated" ("una vez abierto, consérvese en refrigeración") may be included.
4.2.7.3 Expiration dates indicated by the manufacturer on pre-packaged products cannot be modified or hidden in any way.
4.2.8 Nutritional information.
4.2.8.1 Nutritional information on the label of pre-packaged products is voluntary. It is mandatory only when a quantity or quality declaration of a nutritional property is specified. Pre-packaged foods and non-alcoholic beverages regulated by specific norms will be subject to such norms.
4.2.8.2 Nutrients that must be declared.
4.2.8.2.1 When nutrient declaration/nutritional information is included on pre-packaged products, it is mandatory to specify the following, except for pre-packaged foods and non-alcoholic beverages regulated by corresponding legal ordinances:
a) energy contents;
b) protein, available carbohydrates and fat (lipid) quantities;
c) sodium quantity;
d) the quantity of any other nutrient that is the subject of a property declaration; and
e) quantity or quality declaration of any nutrient or ingredient on the label, regulated by the correspondent legal ordinances.
4.2.8.3 Presentation of nutritional information.
4.2.8.3.1 Nutrient declarations/nutrition information must be made in the corresponding numerical units. Other additional means of presentation may be used.
4.2.8.3.2 Energy contents must be expressed in kJ(kcal) per 100 grams or by serving or by package, if the item contains only one serving.
4.2.8.3.3 Protein, carbohydrate and fat (lipid) quantity declarations contained on the foods must be expressed for each 100 g or per serving or per package, if the package contains only one serving.
4.2.8.3.4 Vitamins and minerals numeric declarations must be expressed in metric units or in a percentage of recommended daily allowances (IDR by its acronym in Spanish - ingesta diaria recomendada) per 100 grams or per serving or per package, if the package contains only one serving.
4.2.8.3.5 In these cases, the following chart of balanced recommendations for the Mexican population must be used.

4.2.8.3.7 Tolerance and compliance.
Corresponding authorities may establish tolerance limits related to public health requirements in nutritional information. Mexican Official Norms shall regulate stability during storage, precision of analysis, different production grades, and instability and variability of the nutritional content of the product, depending on whether the nutrient has been added to the product or is naturally present in it.
4.2.8.3.8 Bromatology composition values contained in the nutritional information for the food or non-alcoholic beverage must be derived from internationally recognized analysis, databases or charts.
4.2.9 Nutrient properties declaration.
4.2.9.1 Notwithstanding the provisions of this Norm, every declaration about nutrient properties must be subject to the provisions of the correspondent legal ordinances.
4.2.10 Mandatory requirements presentation.
4.2.10.1 General.
4.2.10.1.1 Labels on pre-packaged products must be fixed in such a way that they stay secure until the use or consumption time under normal conditions, and must be applied for each unit, multiple or joint package.
4.2.10.1.2 When pre-packaged foods and non-alcoholic beverages are packed in a multiple or joint package for their sale to the consumer, the information referred to in this Mexican Official Norm must be included on such package. Nevertheless, lot indication and expiration or "best before" date must appear on pre-packaged foods and non-alcoholic beverages and will not have to be indicated on the multiple or joint package. Also, pre-packaged foods and non-alcoholic beverages must have the statement "Not labeled for individual sale" ("no etiquetado para su venta individual").
4.2.10.1.3 Information that must appear on the label must be indicated with clear, visible, indelible characters and contrasting colors, it must be easy to be read by the consumer under normal circumstances of purchase and use. Information related to lot may be placed anywhere on the package.
4.2.10.1.4 When the package is covered with wrap, all necessary information must be on such wrap, unless the label in the package may be easily read through the exterior wrap.
4.2.10.1.5 At least the brand and denomination of the pre-packaged food or non-alcoholic beverage must appear on the main exhibit surface of the product. The rest of the information referred to in this Mexican Official Norm may be indicated on any other part of the package.
4.2.11 Language.
4.2.11.1 Pre-packed foods and non-alcoholic beverages must show the label in Spanish; it does not matter if it is also expressed in other languages. When information is expressed in other languages, it must also appear in Spanish, at least in the same size and typographical proportions and in an equally ostensible way.
4.2.11.2 Graphic representation or information presented on the label other than that required by this Mexican Official Norm, which information may be in another language, is optional, and it shall not substitute, but supplement, the labeling requirements in this Norm, provided this information is necessary to help the consumer avoid being misled or defrauded.
4.3 Optional information requirements.
4.3.1 "Best before" date.
4.3.1.1 "Best before" date for the conservation of pre-packaged products is optional. If included, the following must be observed:
I) Manufacturer must declare on the label or package the "best before" date, which should be at least:
- For products with a maximum life of three months, day and month;
- For products with a life over three months, month and year.
II) Date must be preceded by a statement specifying such date refers to the best time for the product to be consumed.
4.3.1.2 When a "best before" date is declared, any conditions required for the conservation of the pre-packed product must be indicated on the label or the package.
4.3.1.3 Once the "best before" date is established at the moment the pre-packed product is manufactured, it may not be altered.
4.3.2 Supplemental nutritional information.
Supplemental nutritional information, written or graphic, on the foods and non-alcoholic beverages labels is optional and should never substitute the nutrient declaration, except for foods and non-alcoholic beverages modified in their composition, which must comply with applicable legal ordinances.
4.3.2.1 When supplemental nutritional information is presented, the following criteria must be applied:
a) The specification of one of the following nutrients does not require the specification of another; such specification need only be made if an IDR (RDA) is assigned and the contents of the serving contain over 5% of the IDR:
Protein (% IDR), Vitamin A (% IDR), Vitamin E (% IDR), Vitamin C (% IDR), Vitamin B1 (Thiamine) (% IDR), Vitamin B2 (Riboflavin) (%IDR), Vitamin B6 (Piridoxin) (% IDR), Vitamin B12 (Cobalamin) (% IDR), Folic Acid (Folacin) (% IDR), Niacin (Nicotinic Acid) (% IDR), Calcium (% IDR), Phosphorus (% IDR), Magnesium (% IDR), Iron (% IDR), Zinc (% IDR), Iodine (% IDR).
b) All or none of the following:
Polyunsaturated fat _____g;
Mono-unsaturated fat _____g;
Saturated fat _____g;
Cholesterol _____mg.
c) Specification of one of the following does not require the specification of another:

4.3.3 Usage instructions.
The label must have usage instructions when necessary, concerning how to use the product, including reconstitution, if applicable, to assure the correct usage of the pre-packed food or non-alcoholic beverage.
4.4 Additional information
Any information or graphic representation as well as any written, printed or graphic matter, may be presented on the label, provided it is not inconsistent with the mandatory requirements of this Norm, including those concerning property declarations stipulated in section 4.1.1.
4.4.1 When quality designations are used, they must be easy to understand, accurate and true (non-deceiving).
4.4.1.1 Also, the label may show any accurate and true (non-deceiving) information or graphic representation indicating that the package containing the food or non-alcoholic beverage does not affect the environment.
Calculations
5.1 Nutrient calculation.
5.1.1 Energy.
The amount or quantity of energy to be declared must be calculated using the following conversion factors:
Carbohydrates 17 kJ or 4 kcal/g
Protein 17 kJ or 4 kcal/g
Fats 38 kJ or 9 kcal/g
5.1.2 Protein.
The amount or quantity of protein to be declared must be calculated using the following conversion factors:
Protein = nitrogen total contents Kjeldahl X 6.25
5.1.3 Wheat.
When dealing with wheat derivatives, the following formula applies:
Protein = total nitrogen contents Kjeldahl X 5.7
6. Prohibited Properties on information declarations
6.1 The following property declarations are prohibited:
6.1.1 Properties
- Statements that imply that a recommended diet with ordinary foods or non-alcoholic beverages cannot supply sufficient amounts of all nutrients.
- Statements about properties that cannot be proved.
- Statements about the usefulness of a food or non-alcoholic beverage to prevent, relieve, treat or cure an illness, disorder or physiological state.
- Statements that may raise doubt about the harmfulness of similar foods or non-alcoholic beverages, or cause or exploit the fear of the consumer and use it for commercial purposes.
- Statements that a food or non-alcoholic beverage has acquired a special or superior nutrient value thanks to the addition of nutrients, such as vitamins, minerals or proteins.
6.1.2 Misleading Statements
- Statements about properties that are meaningless, including comparative and superlative ones.
- Statements about proper procedures of hygiene or commerce, such as "genuinity" ("genuinidad"), "healthiness" ("salubridad"), "health" ("sanidad"), except for those specified in other applicable legal ordinances.
- Statements that assure the "organic" or "biological" nature or origin of a food or non-alcoholic beverage, except for those cases in which it has been proven the product actually has such characteristic.
7. Warning statements
7.1 Warning statements must refer to the ingredient or origin of the ingredient that, based on recognized scientific information, is associated with actual or potential risks related to digestive intolerance, allergies or metabolic sicknesses or toxicity.
7.2 Specific warning statements by product and its characteristics will be established in the correspondent official norms.
7.3 Warning statements suggesting a balanced diet may be included.
7.4 The presentation of statements must comply with the provisions of section 4.2.10 of this Norm.
8. Surveillance
This Norm shall be enforced by competent authorities, in accordance with applicable legal ordinances and accredited Verification Units.
