VENEZUELA : NEW RULES FOR INTERNAL AND EXTERNAL COCOA AND EXTERNAL COFFEE MARKETING

A Joint Resolution by the Ministries of Finance, Development and Agriculture Nos. 068 -0909 -3,047, respectively, dated 15 March 1996 (O.G. No. 35,928 of 26 March 1996) issued new rules for the internal and external marketing of cocoa and the external marketing of coffee. The National Cocoa Fund, independent producers, organizations of producers, consortia, cocoa processing industries and corporations made up by them will market cocoa grain, after being qualified by the Ministry of Agriculture according to the requirements set forth in the Joint Resolution. The Joint Resolution further provides for a series of requirements and obligations to be met and fulfilled by eligible parties, lest the qualification for marketing be repealed.

Joint Resolution Nos. 07 -0910 -3,048 of 15 March 1996 of the Ministries of Agriculture, Development and Finance, contains the rules for exporting grain cocoa and its by-products. A required authorization from the Ministry of Agriculture will be issued once a representative sample of the lot to be exported has been examined. According to the Joint Resolution, the exportation of grain cocoa may be carried out by the National Cocoa Fund, duly authorized independent producers, organizations of producers, consortia, cocoa processing industries and corporations made up by said industries. The Joint Resolution further sets a series of obligations for exporters to keep control and records of the exports.

Joint Resolution Nos. 069 -3,049 -0911 of 15 March 1996 of the Ministries of Agriculture, Finance and Development respectively, provides the rules for the external marketing of coffee. One obligation is for coffee exporters to be registered with the Ministry of Agriculture. Another obligation is for the exporter to have the authorization for exportation and certificate of origin issued by the Ministry that will be required for all coffee exports. The authorization to export will be granted once a sample of each lot of 250 bags of 60kgs. to be exported has been examined.

Customs authorities will demand the export authorization from the interested parties as well as the phytosanitary permit and the relevant certificate of origin for each lot to be exported. The Joint Resolution sets a series of requirements and obligations destined to keep a control and registration of coffee exports.
