The North American Free Trade Agreement (NAFTA) ushered in a new era of cross-border movement of goods and services between the United States, Mexico and Canada. Numerous changes and additions were made to Mexico’s Constitution and laws to facilitate the implementation of NAFTA, including the establishment of Mexico’s current maquiladora program.

Free trade is inevitably linked to labor relations issues. Mexican & U.S. Labor Law and Practice: A Practical Guide for Maquilas and Other Businesses is a comprehensive, practical manual for business persons, human resource managers and legal practitioners working for or with maquilas, joint ventures or other foreign companies that hire Mexican or U.S citizens to work in Mexico. The manual describes the current state of U.S. and Mexican labor laws, identifying how and when they apply to workers.

Mexican & U.S. Labor Law and Practice: A Practical Guide for Maquilas and Other Businesses discusses the collateral labor side agreement to NAFTA, the North American Agreement on Labor Cooperation (NAALC). The manual looks at the scope of the NAALC and the first three years of its implementation.

It also addresses those portions of Mexico’s Federal Labor Law most relevant to companies with subsidiaries in Mexico or that are considering relocating to Mexico. Minimum employment standards in Mexico, including wages, bonuses, vacation time and working hours, are examined. A standard employment contract containing the elements required under Mexican law is included in the appendices.

In preparing Mexican & U.S. Labor Law and Practice: A Practical Guide for Maquilas and Other Businesses, NLCIFT labor and employment law experts analyzed and compared U.S. and Mexican labor and employment law. They also conducted numerous field interviews to determine actual business practices in Mexico. The manual outlines how and when these differ from the law on the books.

Mexican & U.S. Labor Law and Practice: A Practical Guide for Maquilas and Other Businesses addresses common employer-employee issues, such as contract negotiations, collective bargaining, hiring and firing, and how to handle them from a risk prevention standpoint.

The manual explains the structure and practice of Mexico’s federal and state labor courts and discusses what an employer should expect if a Mexican worker files a labor complaint. Sample complaint and answer forms are provided, as well as an English-Spanish glossary of commonly used labor terms.

Proceeds from the sale of this manual support the NLCIFT’s work in identifying disparities and increasing understanding and cooperation among the countries of the NAFTA region in trade and labor matters.
